Board of Zoning Appeals

Zoning Codes regulate land use and building location in a manner consistent with the general welfare of the community. Designed to achieve an orderly pattern of land use and development, zoning stabilizes property values. Once a property has been zoned, while limited to that use the owner is assured that neighboring property will be used in the same manner.

The Planning Division can provide zoning information on specific property and verify that existing uses are allowed. The office also investigates complaints of alleged violations of the zoning code. Zoning information, applications for zoning approval, variances and conditional use may be obtained by calling or visiting the Planning Division office.

The Board of Zoning Appeals is composed of five members appointed by the City Manager. These citizens volunteer their time to hear cases and determine whether to enforce adherence to the zoning code or to grant a variance. The Building and Zoning Administrator serves as secretary of the board.

The Board can only hear a variance request after plans have been submitted and reviewed by the Construction Services Division. If plans are rejected, a letter citing the violation is sent to the applicant along with instructions and an application for filing a variance request. Applications are submitted through the Construction Services Division for approval by the Board of Zoning Appeals. The Board meets the first Thursday of each month at 2:00 p.m. in the council chambers located on the first floor of the municipal building and is open to the public.

If you decide you wish to establish a home occupation, you must make an application for a zoning review. Your request will be reviewed for code compliance and a Certificate of Approval given. Sections 1115.42 and 1115.421 from the Hamilton Zoning Code list the criteria to qualify for a home occupation approval.
